Welcome to Kira Secret Skincare (“we”, “us”, “our”, “Kira Secret”). These Terms & Conditions (“Terms”) govern your use of kirasecretskincare1.com (“Site”) and your purchase of products from us. By accessing or using the Site, placing an order, or otherwise interacting with us, you agree to these Terms. If you do not agree, you must stop using the Site.

1. Definitions & Interpretation

  1. “Customer” / “You” / “User” means any person who visits the Site, makes an order, or otherwise interacts as a buyer or prospective buyer.
  2. “Products” means cosmetic, skincare, health, beauty, or related items offered on the Site, whether produced by us or supplied by third-party vendors or manufacturers.
  3. “Order” means a request by you to purchase one or more Products via the Site.
  4. “Vendor / Seller” means any third party whose Products are sold on the Site (if you allow third-party listings).
  5. “Delivery Service” / “Courier” means any shipping, postal, logistics, or courier company used to deliver Products to you.
  6. “Payment Provider” means any third-party payment gateway, card processor, bank, or escrow service used for payments.

2. Applicability & Modification

  • These Terms apply to all transactions and interactions on the Site, including purchases, returns, refunds, disputes, and usage of the Site content.
  • We may update, modify, or amend these Terms at any time. When we do, we will post the revised version with a new “Last Updated” date. Your continued use after changes constitutes acceptance.
  • If any clause is invalid or unenforceable, the rest shall remain valid.

3. Account Registration & Security

  • To place orders, you may be required to register for an account. You agree to provide accurate, current, and complete information.
  • You are responsible for maintaining the confidentiality of your account password and security. You must promptly notify us of any unauthorized use of your account or security breach.
  • We reserve the right to suspend or terminate accounts (with or without notice) for suspected fraud, abuse, or violation of these Terms.

4. Products, Pricing & Orders

  1. Product Descriptions & Availability
    • We strive to ensure product descriptions, images, specifications, and prices are accurate and current.
    • However, we do not guarantee that all details are error-free. If a Product is not available after your Order, we will notify you as soon as possible and offer a refund or alternative.
    • Pricing on the Site is quoted in [currency, e.g. NGN / USD] and excludes shipping unless stated.
    • We reserve the right to change prices, correct errors, or discontinue Products at any time prior to Order fulfillment.
  2. Order Acceptance
    • Your order is an offer to purchase. We reserve the right to accept or refuse any Order for any reason (e.g. stock unavailability, suspected fraud, error).
    • You will receive an order confirmation (by email or via Site) once your order is accepted. This does not mean your order has shipped; shipping notification will follow separately.
  3. Payment
    • You agree to pay all amounts due (product cost, shipping, taxes, duties) using the available Payment Providers.
    • We use secure, standard encryption for payment processing. However, we are not responsible for errors or breaches arising from Payment Providers (except to the extent caused by our negligence).
    • In case of payment failure or chargeback, we reserve the right to cancel your Order or suspend your account.

5. Shipping, Delivery & Risk

  1. Shipping & Delivery
    • We ship to addresses as specified on the Site. Delivery times depend on your location (domestic or international) and courier performance.
    • You must provide a correct, full delivery address. If a delivery fails due to your error (wrong address, absence, refusal), additional redelivery fees may apply, or the order may be forfeited at our discretion.
  2. Risk & Title
    • Risk in the Products passes to you when the courier physically hands over the package (or when it is deemed delivered).
    • Title (ownership) also passes to you upon full payment, unless otherwise stated.
  3. Customs, Import Taxes & Duties
    • For international orders, you are responsible for all customs duties, import taxes, and fees levied by your country.
    • We may assist with documentation but cannot guarantee avoidance of such charges.

6. Returns, Refunds & Cancellations

  1. Cancellation by You
    • You may cancel an Order before it has shipped (if feasible), by contacting us.
    • Once shipped, cancellation is not possible — you must follow our returns procedure (if eligible).
  2. Return Eligibility
    • Returns are accepted only if the Product is unused, in original packaging, with all seals intact, and returned within a specified period (e.g. 7–14 days) from delivery.
    • The cost of return shipping may be borne by you unless we shipped in error or the item is defective.
  3. Refunds
    • Once we receive and inspect the returned Product, we will issue a refund (excluding original shipping) or exchange, if criteria are met.
    • Refunds will be made via the original payment method within a reasonable processing time (e.g. 7–14 business days).
    • We reserve the right to refuse refunds for Products that show signs of use, damage beyond defects, or missing components.
  4. Defective / Incorrect Items
    • If you receive a damaged, defective, or incorrect item, notify us within a reasonable timeframe (e.g. 48–72 hours) with photo evidence.
    • We will, at our option, offer replacement, repair, or refund (including shipping) after verification.

7. Prohibited Use & Warranty Disclaimer

  • You agree not to use the Site to:
    a) violate laws, regulations or third-party rights;
    b) upload or transmit harmful or malicious content;
    c) interfere with site operations or security;
    d) use bots, scraping tools, or reverse-engineer the Site.
  • No Guarantee on Results
    • Products do not guarantee particular results (e.g. “whitening” or “blemish removal”) — outcomes depend on individual skin type, consistency of use, other conditions.
    • All Products are provided “as is” and “as available.”
    • To the fullest extent permitted by law, we disclaim all warranties (express or implied), including merchantability, fitness for a particular purpose, noninfringement.

8. Limitation of Liability

  • To the maximum extent permitted by law, Kira Secret (and its officers, employees, agents) shall not be liable for:
    a) indirect, incidental, special, consequential, punitive damages;
    b) loss of profits, data, goodwill, or business interruption;
    c) claims arising from third-party acts (couriers, payment providers, customs).
  • Our total liability for any claim arising from or relating to your use of the Site or Products shall not exceed the amount you paid for the relevant Order.

9. Intellectual Property

  • All content on the Site (text, graphics, logos, images, designs, software, trademarks) are our property or licensed to us.
  • You may not reproduce, distribute, modify, or create derivative works without our prior written consent.
  • You retain ownership of any content you upload (e.g. reviews) but grant us a perpetual, royalty-free license to use, display, and adapt it.

10. Privacy & Data Protection

  • We collect, store, and process personal data (name, address, contact, email, payment info) necessary to fulfil orders, communicate with you, improve services, and comply with legal obligations.
  • We implement industry-standard security measures (encryption, access controls) to protect your data.
  • We do not share your personal data with unrelated third parties without consent—except with payment providers, courier services, or legal demands.
  • Cookies & tracking: We use cookies and similar technologies for site functionality, analytics, personalization, and marketing. You can manage or disable cookies via browser settings (though some features may break).

11. Dispute Resolution & Governing Law

  • These Terms will be governed by and construed in accordance with the laws of Nigeria (or state jurisdiction) — unless otherwise agreed in writing.
  • Any dispute arising will be resolved via negotiation, and if that fails, via courts or arbitration in (Lagos, Nigeria) or another mutually agreed forum.
  • You waive any right to a jury trial or class action (to the extent law allows).

12. Indemnification

You agree to indemnify, defend, and hold harmless Kira Secret and affiliated parties from and against all claims, liabilities, damages, losses, and expenses (including attorneys’ fees) arising out of or relating to:

  • your breach of these Terms;
  • your misuse of the Site or Products;
  • violation of rights of a third party.

13. Third-Party Links & Services

  • Our Site may include links or references to third-party sites, apps, or services (e.g. payment gateways, social media). Those are provided for your convenience; we are not responsible for their content, policies, or operations.
  • If you use third-party services, you must comply with their terms as well.

14. Force Majeure

Neither party will be liable for failure or delay in performance caused by events beyond reasonable control (natural disasters, war, strikes, epidemics, government acts). In such event, performance is suspended for the duration of the event.

15. Miscellaneous

  • Entire Agreement: These Terms (plus any policies referenced) constitute the entire agreement between you and us regarding the Site and Products, superseding prior agreements.
  • Waiver: A failure or delay in enforcing any right does not waive that right.
  • Severability: If one term is invalid, the rest remain in effect.
  • Notices: We may send notices via email or posting on the Site; you should check updates regularly.
